Pensioners’ Dhvani April 2020 Issue
The country is under lock down due to COVID-19.  As a result all establishments are closed or working with depleted strength to maintain essential services.   Under these circumstances it is not possible to publish April 2020 as per schedule.  It is publish April and May issue together in May 2020.   We earnestly hope near normalcy is there and we will be able to bring out the journal by May 16, 2020.  This newsletter is being sent to all members who are having Mail ID and also will be posted in our website www.pensionersdhvani.blogspot.com.  
10th Anniversary Celebrations Postponed
10th Anniversary celebrations of foundation of our Association scheduled for 9 May 2020 has been postponed.  The postponement became a necessity because of continued lockdown and need for maintain Social distance under prevailing health emergency.  The date of celebrations will be finalised after the restoration of normalcy.  The release of Directory of members also stands postponed.  The members who have not sent the photos and donation of Rs.200/ towards printing of directory may please send the same before end of May 2020.
Appeal for special fund for contributing to PM CARES fund/ CM Fund:
India is on war against COVID 19. The pandemic COVID-19 is spreading its wings all over the world.  Central Government to prevent spreading of virus in India has declared nationwide Lock Down for 21 days from 24 March 2020. The workers in organized sector have been asked to work from home.  Wherever it is not possible to work from home they are given paid holiday.   Out of the total workforce in India only 15 per cent are in organized sector. Workers in unorganised sector who constitute major part of work force are on daily wages working as construction workers, contract workers, hamalies and etc.  Most of them are not even having BPL card and mostly migrant workers from rural side. When lock down was declared these workers started moving to their places. The fear of spreading of vires was looming large.   To prevent such a catastrophe the Government is providing shelter and food to them by hiring Kalyan Mantaps.  The Government also has to spend huge amount to improve the health facilities and provide protection to health workers.  To meet exigencies of such situations and to provide relief to citizens the Government has set up Public Charitable Trust under the name “Prime Minister’s Citizen Assistance and Relief in Emergency Situations (PM CARES) Fund.  Our Association has made initial contribution of Rs.50,000/ on 30 March 2020 to this fund.  We wish to make further contribution to this fund as well as Karnataka CM fund also.  Therefore we appeal to all members to contribute minimum one day Pension or Rs.1000/ whichever is higher.  You can send contribution in the following manner.
Remittance can be made by any of the Following methods:
Ø  By drawing Cheque/Draft in favour of “Karnataka IA& AD Pensioners' Association”;
Ø  By crediting amount to our current account CA No 50 in AGOECB and intimate Association;

1          Anand Diagnostic Laboratory has been de-empanelled by CGHS from 1-4-2020 at the request of the service provider
2          Reimbursement of OPD medicines to CS (MA) beneficiaries: Special Sanction in view of COVID-19

3          Subject: Reimbursement of OPD medicines to CS (MA) beneficiaries -Special Sanction in view of COVID-19 -reg.
[MoH&FW OM No, S-11011/12/2020-EHS dated 1-042020]
In view of the Corona Virus Disease (COVID-19) pandemic, all out efforts are being made by the Government to contain the impact by instituting measures at community as well as Individual level.
2. Guidelines for maintaining social distancing between individuals have already been issued by the Government. In the spirit of above guidelines, the undersigned is directed to state that CS (MA) beneficiaries getting medicines for chronic diseases may purchase medicines from the local pharmacy till 30.04.2020, based on the prescription of Authorized Medical Attendant, already held by the beneficiaries.
3. The Medical claim for reimbursement shall be submitted by the beneficiary to the concerned Ministry/Department/Organization for further processing.

4          Subject: Extension of Validity of CGHS Card in view of the Corona Virus (COVID-19) Infection.
[DG CGHS OO No. Z.15025/17/2020/ DIR/CGHS/ dated 1-04-2020]
In view of the Corona Virus Disease (COVID-19) , all out efforts are made by the Government to contain its impact by instituting measures at community as well as at individual level. Guidelines for maintaining social distancing between individuals have already been issued by the Government.
In the spirit of above guidelines, the undersigned is directed to convey that the validity of CGHS Cards expiring on 31st March 2020 may be extended in respect of CGHS pensioner beneficiaries contributing on annual basis and Central Government serving employees superannuating on 31.03.2020, as per the details given under:
(i) In case of CGHS pensioner beneficiaries, who contribute the subscription on annual basis and whose CGHS cards are valid till 31st March 2020, the validity period may be extended till 30th April 2020 in the Data Base, by Additional Directors City/ HQ (in Delhi) on the basis of request received over e-mail from such A paper print-out may be signed and scanned copy of the same shall be sent to the beneficiary by e-mail , with a direction to submit the relevant documents and subscription before 30th April 2020.
 (ii) Similarly, if a request is received by e-mail from serving employees, who superannuated on 31.03.2020 and are not in receipt of PPO, the CGHS Card may be converted as pensioner CGHS Card and validity period extended to 30th April A paper print-out may be signed and scanned copy of the same shall be sent to the beneficiary by e-mail with a direction to submit the relevant documents and subscription before 30th April 2020. Additional Director City/ HQ (in Delhi) will verify the date of superannuation from CGHS database before processing the request. If a Govt Servant superannuating on 31 .03.20 was not a member of CGHS during service then he will have to submit a proof of superannuation.
(iii) The period of extension will be included when the card validity is regularised on depositing the subscription.
(iv) That these relaxations are being made to help the CGHS beneficiaries in view of extraordinary conditions due to Covid 19 and will not be cited as a precedence in future.

5          Extract of WhatsApp chat with Additional Director CGHS regarding CGHS facilities in suspected COVID cases

Beneficiaries have following doubts:
1. In suspected Covid cases is testing covered under CGHS.  In such cases reference from WC required.
2. In positive cases and hospitaisation is cashless facilities available.

6          CGHS – Procedure for Issuance of Restricted Medicines for cancer and other such conditions

Restricted medicines include chemotherapy medicines for cancer and other medicines as enumerated in the “restricted drugs” list of CGHS. This list is available in under “circulars”. When restricted medicines like those for cancer and other such conditions are prescribed the following procedure is to be followed:-
1. An authority slip for MSD/ AD of the city will be issued from the wellness center for the restricted drugs on the specialist prescription.
2. This authority slip along with following documents (all duly verified by CMO I/C) are to be submitted at MSD/AD‟s office.
– Application to AD forwarded by CMO I/C
– Copy of specialist prescription/discharge summery (Emergency cases) indicating restricted drugs
– Copies of investigation reports
– Permission letter for treatment in CGHS recognized hospital
– Photocopy of CGHS card
– Utilization certificate (This is required when the same medicines have been issued earlier also. The certificate in case of orally administered medicines can be given by the beneficiary himself and for those administered parentally certificate from CMO I/C or treating specialist is required.)
– Person (If not beneficiary himself) who is to collect these medicines must carry authorization letter, the original CGHS card and his photo I/D

Fixed Medical Allowance and the eligible Amount – Frequently Asked Questions
1. What is the Fixed Medical Allowance for pensioners? What is it’s amount?
Fixed Medical Allowance is granted to the pensioners residing in areas not covered by CGHS, if they are not using CGHS facility for OPD treatment from a CGHS dispensary in the nearest city. The amount of Fixed Medical Allowance has been increased from Rs. 500/- per month to Rs. 1000/- per month w.e.f. 01.07.2017.
2. Are the Government Pensioners who have not applied for CGHS card in spite of residing in areas covered by CGHS, also eligible for Fixed Medical Allowance?
In accordance with Office Memorandum No. 45/57/97-P&PW(C) dated 19.12.1997, Central Government pensioners/ family pensioners residing in areas not covered by Central Government Health Scheme administered by Ministry of Health and Family Welfare and corresponding Health Schemes administered by other Ministries/ Departments for their retired employees are entitled to Fixed Medical Allowance (FMA) for meeting expenditure on day-to-day medical expenses that do not require hospitalization. Government pensioners/ family pensioners residing in CGHS covered areas are eligible to avail medical facility under CGHS for both indoor as well as outpatient treatment on payment of CGHS contributions. Those pensioners/ family pensioners residing in CGHS areas who do not opt to avail CGHS facility are not eligible to receive FMA. Government pensioners/ family pensioners residing in Non CGHS area are also entitled to avail CGHS facility from the nearest city covered by CGHS for the both Indoor and OPD treatment on payment of CGHS contributions. If they do not avail CGHS facility, they are eligible for FMA. Government pensioners/ family pensioners not residing in CGHS area have an option to avail CGHS facility from the nearest CGHS city for Indoor treatment only (on payment of CGHS contribution) and to get monthly FMA in lieu of OPD facility.
3. In the case of those Pensioners who are in receipt of two pensions viz., service pension and family pension OR military pension and another civil pension to which category of pension, medical allowance shall be allocated.
If any pensioner or family pensioner receives two pensions, Fixed Medical Allowance is admissible from only one of the two organizations. As regards, pensioner who gets both military pension and civil pension, if the pensioner avails of the medical facilities provided by one of the civil or military organisations, he is not entitled to Fixed Medical Allowance and if he does not avail medical facilities from any of the organizations, he is entitled to Fixed Medical Allowance for only one of the two organizations.

MACP in Promotional Hierarchy as in the case of ACP Scheme – Hon’ble Supreme Court decides against Employees demand of grant of Grade Pay on MACP at par with Promotional Post
MACP in Promotional Hierarchy – In a landmark Judgement in favour of Government India, Hon’ble Supreme Court set aside all the Orders of High Court which were in favour of Employees side for grant of grade pay on MACP at par with grade pay Promotional Post granted in the case of ACP.  The Bottom line is Central Government Employees would continue to be granted MACP to the next grade Pay / Next level (post 7th CPC) irrespective grade pay / pay level pertaining to next promotional post.  The justification given by Hon’ble Supreme Court for the dismissal of High Court Decisions is as follows:
“The ACP Scheme which is now superseded by MACP Scheme is a matter of government policy. Interference with the recommendations of the expert body like Pay Commission and its recommendations for the MACP, would have serious impact on the public. The recommendations of the Pay Commission for MACP Scheme has been accepted by the Government and implemented. There is nothing to show that the Scheme is arbitrary or unjust warranting interference. Without considering the advantages in the MACP Scheme, the High Courts erred in interfering with the government’s policy in accepting the recommendations of the Sixth Central Pay Commission by simply placing reliance upon Raj Pal’s case. The impugned orders cannot be sustained and are liable to be set aside”


OBITUARY

HONGAL DB (LM 475) expired on 29-03-2020.   He had retired on 30-11-2008 from O/o The Principal Director (Commercial) as Supervisor.

SRIPATHY P.R. (LM 272) expired on 11-04-2020.   He had retired on 30-09-2008 from O/o The Accountant General (Audit) as Sr. Audit Officer.
